1.1 The WAX iOS and Android mobile application (“App”) and website at https://app.wearexapp.com and https://wearexapp.com (“Website”) are provided by WeAreX Ltd (“WeAreX”, “WAX”, “us”, “we”, or “our”). Our registered office is at 12 Hallmark Trading Estate, Fourth Way, Wembley, England, HA9 0LB, and our registered number is 07613827.
1.2 These terms (“Agreement”) govern the optional prepayment plan (“X Pay”) provided to facilitate the purchase of tickets (“Products”). This service is designed to enable convenient payment in installments and is not a credit agreement under UK law.

Eligibility
2.1 To use the X Pay Prepayment Plan, you must:
Be at least 18 years old.
Have a verified WAX account.
Possess a valid payment card with sufficient funds to cover all installments
2.2 You are responsible for ensuring that the use of the installment plan complies with all local laws and regulations applicable to your place of residence. This service may not be available in all jurisdictions.
How X Pay Works
3.1 X Pay allows you to split the cost of your tickets into equal installments. The payment schedule is displayed at checkout before purchase.
3.2 An initial payment (“Initial Payment”) is required at the time of purchase. Subsequent installments will be automatically charged to your payment card as per the schedule provided at checkout.
3.3 The plan is a service fee-based convenience offering, not a credit agreement. Ownership of the tickets remains with us until all installments are paid in full.
3.5 All purchases are subject to payment card verification and other security checks. Transactions may be canceled if they do not pass verification processes.
3.6 You may update your card details online at any time. If your card is canceled or its details change, you are required to notify us and provide updated information. Failure to do so may result in cancellation of the installment plan and tickets, without a refund.
Fees
4.1 A one-time nominal administrative fee of £3 applies per order. This fee is fixed and covers the costs of processing multiple transactions associated with the X Pay service.
4.2 This fee is not linked to the ticket price or calculated as a percentage of the amount payable. It is charged solely to offset operational costs, such as payment processing and administrative overhead.
4.3 The X Pay service does not charge interest, late fees, or penalties. The fee is clearly displayed at checkout.
Payment Schedule and Cancellations
5.1 Payments will be automatically charged according to the agreed schedule. Failure to complete payments may result in the cancellation of the ticket order.
5.2 In the event of payment failure:
We will notify you and attempt to retry the payment at regular intervals.
If payment remains unsuccessful after multiple attempts, your ticket order will be canceled, and previously paid amounts will not be refunded.
Transparency and Compliance
6.1 X Pay is a fee-based service, not a form of credit or borrowing. It does not accrue interest or other charges typically associated with credit agreements.
6.2 The nominal fee is disclosed clearly at checkout and does not exceed the reasonable costs associated with providing the service.
6.3 WeAreX Ltd is not a lender and is not authorized or regulated by the Financial Conduct Authority (FCA). The X Pay service is designed to comply with applicable consumer protection laws.
6.4 To illustrate, the £3 administrative fee remains fixed regardless of the ticket price. Here are two examples:
Example 1: Lower-priced ticket
Ticket Price: £30
X Pay Fee: £3
Total Cost: £33 (split into installments as per your payment plan)
Example 2: Higher-priced ticket
Ticket Price: £300
X Pay Fee: £3
Total Cost: £333 (split into installments as per your payment plan)
These examples demonstrate that the X Pay fee is a nominal, fixed charge applied to each transaction and does not vary based on the ticket price. This ensures that the fee is transparent, predictable, and proportionate to the cost of providing the service.
6.5 Why We Charge for This Service The X Pay service fee is necessary to cover the costs of facilitating this installment option. Payment processors charge both a percentage of the ticket price (which varies by event) and a fixed fee per transaction. By enabling multiple transactions through X Pay, we incur additional transaction costs that go beyond standard payment processing fees (typically 2.5-4%).
Additionally, operational costs arise from managing the inevitable missed or failed payments. The £3 fee ensures we can provide this convenient service fairly and sustainably without charging interest or creating any form of credit. This nominal fee reflects the actual cost of offering the service and allows us to maintain transparency while ensuring accessibility for all users.
Ownership of Tickets
7.1 Ownership of the tickets remains with us until all installments and applicable fees are paid in full. Tickets will only be released upon full payment.
Governing Law
8.1 This Agreement is governed by the laws of England and Wales. If you reside in another jurisdiction, your local laws may also apply.
8.2 For any complaints or disputes, please contact us using the details provided in Section 10. We aim to resolve issues informally where possible.
Transfer of Rights
9.1 This Agreement is an arrangement between you and us. You may not transfer your rights or obligations under this Agreement to another party without our prior written consent.
